Unnao rape case: Court directs SP Unnao to depute an officer for necessary action

New Delhi [India], May 1 : Delhi's Saket District Court on Wednesday directed the Superintendent of Police (SP) of Unnao, Uttar Pradesh to depute an officer to take necessary action in a case related to allegations of forgery committed by the Unnao gang-rape victim and her family members to manipulate her age.
The Supreme Court had transferred this case to Delhi. A charge sheet has been filed and the matter is at the stage of arguments on charges.
Metropolitan Magistrate (MM) Abhitesh Kumar directed SP Unnao to depute an officer after noting that the previous officer SI Sudhakar Singh had been transferred.
"SP Unnao is directed to depute any police official for further necessary action in this case," MM Abhitesh Kumar said in the order passed on May 1.
On January 24, 2024, the Additional Public Prosecutor (APP) for the State and the Counsel for the complainant both submitted that the complainant has some documents about the age of the accused 'AS' and they want to submit those documents to IO for further necessary action.
On April 06, 2024, it was informed to this court that SI Sudhakar Singh was transferred to PS Kotwali, Janpad Sitapur, UP. After considering the circumstances issued direction to the SP.
The court has directed to send the order copy to SP Unnao. The matter has been listed on August 3 for further hearing.
Legal Aid Counsel (LAC) Arun Kumar appeared for the victim's uncle who is also an accused in this case.
In November 2023, the Delhi High Court granted anticipatory bail to the victim of the Unnao gang-rape case and her mother.
This case pertains to alleged forgery of date of birth. An FIR was registered under sections 419/420/467/468/471 IPC at P.S. Makhi, Uttar Pradesh based on the complaint made by Haripal Singh.
Earlier, the Delhi High Court had granted protection and directed not to take any coercive action against the victim.
The expelled BJP MLA Kuldeep Singh Sengar was convicted in the POCSO Act for the rape of a minor victim. He is serving a life sentence and his appeal is pending before the Delhi High Court.
"In case of arrest either by the trial court or by investigating agency, the petitioners shall be released on bail on furnishing personal bond in the sum of Rs.20,000 with one local surety of the like amount," the High Court had directed on November 21, 2023.
The trial in the matter had been transferred by the Supreme Court through an order of September 2, 2022, passed in Transfer Petition.
It was stated that the petitioner is the victim in FIR registered on June 20, 2017 (Unnao gang rape case) at Police Station Makhi, U.P.
This present FIR alleged that the petitioner and her mother had forged the date of the petitioner's birth certificate in related proceedings so that they could allege offences under the POCSO Act.
