Oct 01, 2026

New Delhi [India], October 1 : US National Matthew Aaron VanDyke appeared before a Rouse Avenue Court through video conferencing from his home country.
He said that he has a return air ticket to India for October 21 and will be appearing before the court.
VanDyke is an accused in the Myanmar Training Camp case. Six Ukranians national are also accused in this case. All accused are on default bail and have been in their countries for one month after the court allowed them to travel abroad.
The Ukrainians have not appeared through video conferencing. An exemption was filed on their behalf.
A Rouse Avenue court listed the chargesheet of NIA for consideration on October 23.
Advocate Amit Rohila appeared as proxy counsel for NIA and submitted that the NIA will inform the court of the development of further investigation and if a supplementary chargesheet is to be filed.
On September 8, the NIA had filed a chargesheet without invoking the sections of UAPA. Only the sections related to offences under the Immigration and Foreigners Act were invoked. The said offences have been compounded before the FRRO.
At the time of filing of the chargesheet, the NIA had said that the further investigation is going on and a supplementary chargesheet will be filed if an offence under UAPA is made out.
The chargesheet was filed after 180 days of custody, and therefore the court had granted a default bail on deposit of Rs 1 lakh each.
The accused filed the present plea for seeking default bail, stating that in the wake of the said incomplete chargesheet, applicant/ accused is entitled to default bail, the court said.
The applicant has sought default bail. It is an admitted position that NIA could not complete the investigation with regard to UAPA offences within the statutory period of 180 days.
The NIA had arrested the accused persons in March 2026 in a case registered under UAPA. The period of investigation was extended twice by the NIA.
